And the recently adopted law on "dacha amnesty" has made it another and one of the most accessible procedures. What documents are required for a transaction of this kind, what difficulties can arise in the course of registration? Read about this in the article.
What is "dacha amnesty"?
So conditionally called the law of the Russian Federation, whichprovides a simplified procedure for registering the building in the suburban area. It was adopted with a view to "simplify life" for the summer residents and allow them to become full-fledged owners of land plots in their indefinite use. Previously, this type of ownership did not allow them to sell land, and therefore significantly limited their rights.
Decoration of the garden: where to start?
So, suppose you decide to sell yourplot of land. Like any other event for the acquisition of property rights, the design of the garden plot should begin with the collection of all necessary documents. Among them:
- an application for state registration that will be drawn up by you directly at the time of delivery of the remaining documents;
- the passport of the citizen of the Russian Federation;
- a document that confirms your right to dispose of land;
- cadastral passport of the site;
- the receipt is a certificate that you paid the state fee.
If the design of the garden plot inproperty you will not produce yourself, and entrust it to one of your trusted persons, then be sure to take with him a notarized power of attorney from you. Otherwise, he will not have the right to represent your interests.
If all documents are on hand, you can proceedcase - apply to the Federal Registration Service at the location of the land. The procedure for registering the site will depend on the specific situation and the presence of negative circumstances (some documents are not available, the plot is on the balance of the summer residence, the land was acquired long ago and all documents were lost, there is everything except the cadastral plan, etc.).
Registration of documents for the garden: some nuances
There are situations when the owner does not have documents proving ownership of land. The reasons for this can be two:
- the first - the owner did not know about the "dacha amnesty" and did not take advantage of the opportunity (or deliberately did not do so not to pay property tax);
- the second - "dacha amnesty" for this site is impossible due to any circumstances.
In such situations, the transactionpurchase and sale according to generally accepted rules is not possible. But you can still transfer ownership to another person - if the seller leaves the partnership, and the buyer at the same time enters. In the documentation of the dacha partnership it will be necessary to make a record that the land now belongs to another owner and issue him with a document that confirms this (for example, a gardener's book). As before, the new owner of the site does not have any documentary grounds for ordering him, that is, for sale. If the buyer agrees that the pre-sale registration of the garden plot will be undertaken, then he should know that the price of such property is much lower than the estimated value, since the procedure of "putting things in order" in documents is sometimes quite expensive (from 30 thousand). It is advisable to use the representative's help in this case. A familiar real estate agent or a lawyer who has the necessary experience in this field can become his.
